These terms apply to your use of crossover.gallery and to every purchase made from or through Crossover Gallery. Part 1 covers the website. Part 2 contains our general sales conditions. Like our privacy statement, they are written to match what we actually do, and we update them when that changes.
Part 1: Website terms
Who we are
Crossover Gallery is a trade name of Q-Bik International V.O.F., registered with the Dutch Chamber of Commerce under KvK number 24291063. We are an online gallery without public premises; viewings are by appointment. You can reach us at info@crossover.gallery.
Using the website
The website presents the artists we work with, their work, our exhibitions and news. You may browse it and share links to its pages. You may not copy, scrape or republish its content, interfere with its operation or security, or use it for anything unlawful.
Artworks, prices and availability
The website is not a shop. Nothing on it is an offer to sell, and no purchase can be made through it. If you are interested in a work, email us. We will tell you whether it is available, the price, the edition number where applicable, and how delivery would work.
A sale is concluded only when we confirm it in writing and issue an invoice. Works are sold on behalf of the artist, which the invoice states. Every purchase is governed by the general sales conditions in Part 2 below. Nothing in these terms limits your statutory rights as a consumer.
Copyright
The artworks shown on this website are the copyright of the artists who made them. They appear here with the artists' permission. The texts, photographs of works, and design of the website are the copyright of Crossover Gallery or the respective artist. You may not reproduce or distribute any of it without written permission. Press and publication requests are welcome by email.
Accuracy of information
We take care to describe works and exhibitions accurately, but we cannot guarantee that every detail is complete or current. Colours on screen differ from the original, and dimensions are approximate unless confirmed in writing. We may change or remove content at any time.
Newsletter
Subscribing to the newsletter is voluntary. Every email contains an unsubscribe link. How we handle your details is described in our privacy statement.
Links to other websites
Where we link to other websites, such as an artist's own site or our social media profiles, we are not responsible for their content or how they treat your data.
Liability
We provide the website as it is. To the extent the law allows, we are not liable for loss arising from your use of the website or from reliance on its content. Nothing in these terms excludes liability that cannot be excluded by law.
Governing law
These terms are governed by Dutch law. Disputes are brought before the competent court in the Netherlands. If you are a consumer, the protections of the law of the country where you live still apply.
Changes
We may update these terms and conditions. The date at the end of this page shows the current version.
Part 2: General sales conditions
1. Definitions
"The Gallery" is Q-Bik International V.O.F., trading as Crossover Gallery (KvK 24291063). "The Artist" is the maker of the work. "The Work" is the artwork described in the Confirmation. "The Buyer" or "you" is the person or company buying a work from or through the Gallery. A "Consumer" is a Buyer acting outside a trade or profession. "The Confirmation" is the Gallery's written acceptance of your purchase, normally an email followed by an invoice.
2. Scope
These conditions apply to every offer, quotation and sale by or through the Gallery, whether concluded by email, at a viewing, at an art fair or elsewhere. Deviations are valid only if agreed in writing. Your own purchasing conditions do not apply. Where the Gallery sells on behalf of an Artist, the Confirmation and invoice say so, and these conditions apply in the same way.
3. Offers and conclusion of the sale
Information on the website is an invitation to enquire, not an offer. A quoted price is valid for the period stated, or otherwise for 14 days. A sale is concluded only when the Gallery confirms your purchase in writing. Until then the Work may be sold to someone else.
4. Prices and costs
Prices are in euros and include VAT unless stated otherwise. Packing, transport, insurance in transit, and any duties or taxes outside the Netherlands are charged on top, at amounts we tell you before you commit. A change in VAT or other government levies may be passed on.
5. Payment
Payment is by bank transfer to the account on the invoice, within 14 days of the invoice date unless agreed otherwise. The Gallery may require full payment before delivery. After a reminder, late payment carries statutory interest and statutory collection costs. If payment is still not made within the period set in the reminder, the Gallery may cancel the sale and claim its loss.
6. Delivery
The Confirmation states how and when the Work is delivered: collection by appointment, delivery by the Gallery or the Artist, or shipment by a carrier. Some works, in particular editioned prints, are produced after the sale, and the Confirmation states the expected delivery time. Delivery follows receipt of payment. Delivery dates are estimates unless expressly agreed as binding. If no date is agreed, we deliver within 30 days of payment. If you do not collect or accept the Work at the agreed time, storage and repeat delivery costs are for your account.
7. Risk and retention of title
Risk of loss or damage passes to you when you, or someone you appoint, receives the Work. If you arrange your own transport, risk passes when the Work is handed to your carrier. The Work remains the property of the Gallery or the Artist until the full price has been paid. Until then you may not sell, pledge or otherwise dispose of it.
8. Right of withdrawal for consumers
If you are a Consumer and bought the Work at a distance, for example by email, or outside the Gallery's business premises, you may withdraw from the sale within 14 days after receiving the Work, without giving a reason. Send us an unambiguous statement by email within that period. You may use the model text below.
Return the Work within 14 days of your statement, undamaged and where possible in its original packaging. The direct cost of returning the Work is for your account; for works that cannot be posted we tell you the estimated cost in advance. We refund everything you paid, including standard delivery costs, within 14 days after we receive the Work back or you show you have sent it. You are liable for any reduction in value caused by handling beyond what is needed to establish the nature and characteristics of the Work. The right of withdrawal does not apply to works made to your specifications or clearly personalised, such as commissions.
Model withdrawal statement: "To Crossover Gallery, info@crossover.gallery. I withdraw from my purchase of [work], confirmed on [date] and received on [date]. [Name, address, date]."
9. Authenticity, condition and conformity
The Gallery guarantees that the Work is by the Artist as described. Editioned works carry their edition number and come with a certificate of authenticity. You buy the Work in the condition it is in at the time of sale. We describe that condition on request and encourage you to view the Work before buying.
If the Work does not conform to the sale, tell us in writing as soon as reasonably possible. A Consumer has the statutory rights to repair, replacement, price reduction or cancellation, and nothing in these conditions limits them. A Buyer who is not a Consumer must report defects within two months of delivery, and their claims lapse one year after the sale. Where the Gallery is liable for damage, it may choose to repair the Work, replace it where possible, or grant a price reduction.
10. Copyright and reproduction
Copyright in the Work stays with the Artist. Buying the Work gives you ownership of the object, not the right to reproduce, publish or exploit its image. Ask the Gallery if you wish to do so; we can mediate with the Artist. Dutch law gives artists a resale royalty on later resales through art-market professionals.
11. Force majeure
If the Gallery or the Artist cannot perform because of circumstances beyond their control, such as illness, transport failure or loss of a work in production, the obligation is suspended. If this lasts longer than three months, either party may cancel the sale, and any payment made is refunded without further compensation.
12. Liability
The Gallery's liability under a sale is limited to the price paid for the Work, except in case of intent or gross negligence, and except where the law does not allow such a limit, in particular towards Consumers. The Gallery is not liable for indirect loss.
13. Personal data
Data you give us for a purchase is processed as described in our privacy statement. Invoice data is kept for seven years as tax law requires.
14. Applicable law and disputes
Dutch law applies, excluding the Vienna Sales Convention. Disputes go to the competent Dutch court. If you are a Consumer, the court of your own place of residence remains competent as the law provides. Please raise any complaint with us by email first; we respond within 14 days.
